David Loh is an experienced commercial litigator who has handled hundreds of matters in both federal and state courts from inception through trial. He has particular experience in resolving international transportation disputes through arbitration or litigation, especially with respect to vessel and aviation casualties. He regularly provides legal advices to carriers, freight forwarders and their insurers based on real world operational concerns.
Experience
Representative casualty matters include:
- Successfully prosecuted tanker owner for USD 75 million in damages arising from allision nearby Freeport, Bahamas.
- Successfully defended freight forwarder against strict liability claims arising from vessel fire off the coast of Southampton, UK, resulting in over USD 50 million in damages.
- Successfully prosecuted tug & barge operator whose anchor struck a submarine cable operated by the Power Authority of the State of New York, resulting in over USD 32 million in damages.
- Successfully defend luxury recreational boat manufacturer against claims asserted by owner arising from grounding outside of San Juan, Puerto Rico.
- Successfully recovered against ground handler for causing significant damage to aircraft fuselage during refueling operations.
Representative personal injury matters include:
- Successfully defend general contractor and building owner against estate of construction worker who was killed inside an elevator at a NYC construction site.
- Successfully defend terminal operator against estate of stevedore who was crushed while loading cargo at an ocean terminal outside of Houston, Texas.
- Successfully defend freight broker in connection with the death of three (3) small children arising from a traffic accident outside of Springfield, Missouri.
Representative corporate matters include:
- Successfully defended HK-based company against allegations of fraud and misrepresentation by Florida asset purchaser.
- Successfully prosecuted logistics provider who exploited weaknesses in ocean carrier’s trucking network to increase their revenue at the expense of the ocean carrier.
He helps a wide range of businesses to assess, manage and resolve transportation related exposures and to exploit opportunities in the highly dynamic world of transportation and energy law. He promptly helps clients to construct and interpret complex business instruments on a regular basis.
He also provides insurance coverage advices, especially with respect to marine and aviation policies.
He regularly serves as an arbitrator before the Society of Maritime Arbitrators in New York.
Before attending law school, David served on active duty in the U.S. Navy as a surface warfare officer, retiring with the rank of lieutenant commander. In law school, David served as executive editor of Boston College Third World Law Journal.
